10+2 Ad cap case adjourned till 25th Sept. 2014

The 10+2 ad-cap case has been adjourned till 25th September 2014 by the Delhi High Court. At a hearing held on 15th September 2014, the court cited two reasons for fixing the mentioned date for the final hearing.

The bench headed by Chief Justice G Rohini and Justice Rajiv Sahai Endlaw citing time constrain states that as the Delhi HC has large number of cases to look into, there will not be sufficient time to hear the ad-cap case. The other reason mentioned to push the date was that the Telecom Regulatory Authority of India (TRAI) is yet to file its rejoinder in the case. The matter is expected to be disposed of when it comes for hearing next. While the interim relief will continue, the petitioners have to submit a weekly report on the consumption of commercial airtime in a clock hour.

To recollect, on 17th December 2013, broadcasters has challenged the ad-cap diktat in Delhi HC after TDSAT dismissed its appeal following the Supreme Court judgement which stated that the tribunal does not authority over TRAI regulations. In the December hearing, the broadcasters were given three months of temporary relief by the Delhi HC when it asked TRAI not to take any coercive action against the news broadcasters for not following the 12-minute mandated ad cap, however, it had also observed that the cap on advertisements is a ‘reasonable exercise’.

As known, some of the parties associated with the case include the News Broadcasters Association (NBA), B4U, 9X Media, TV Vision, Sun TV Network, E24, and Kalaignar TV against the Telecom Regulatory Authority of India. The four major broadcast networks who are complying with the regulation include Star India, Zee Entertainment Enterprises Ltd, Multi Screen Media and TV18 Group.
