Adidas loses trademark case against luxury fashion brand Thom Browne

In less than three hours, the trademark violation suit by Adidas against Thom Browne, the luxury designer, over stripes, was defeated by a Manhatten jury. The suit was filed by the German Sports giant in the year 2021, and claimed that the use of stripes by the luxury designer on its athletic clothing is a violation of the three stripe trademark of Adidas, and would be a cause of confusion for the consumers.
It was asserted by Thom Browne that this was not the case and that the two brands are not straight rivals to each other, besides stating that the number of stripes was contrasting too.
Browne said that its important to fight and tell his story. He also said that he hopes that the conservation of his striped designs on luxury athletic clothing as well as accessories is an inspiration to others whose work poses a challenge to bigger clothing producers.
Adidas had also decided to ask the jury for more than $7.8 million in damages, in addition to penalty damages.
