Delhi HC refuses to grant injunction to BCCL against Republic TV

A day after the Delhi High Court rejected a plea filed by the TV Today Network against Arnab Goswami’s Republic TV in the ongoing row over use of multiple frequency feeds, the High Court has refused to grant any injunction to Bennett, Coleman & Co Ltd (BCCL) against Republic TV in the IPR infringement case. 

As is known, BCCL on May 16, 2017 had lodged a complaint against Republic TV’s Arnab Goswami and Prema Sridevi for “theft, criminal breach of trust, misappropriation of property and infringement of IPR of BCCL” by using the audio tapes containing phone conversations between Lalu Prasad Yadav and Shahabuddin, as well as phone conversations between Prema Sridevi and late Sunanda Pushkar and their house help Narayan. 

While admonishing The Times of India Group for publishing articles against Arnab Goswami and Republic TV and making unethical statements against Goswami, the Delhi High Court refrained The Times of India Group from reporting on the matter. 

In the last ex-parte hearing, the Judge had asked Times Now that if they had the Sunanda tapes with them for two years then why they had not aired them. 

Denying all allegations of IPR infringement, Republic TV told the High Court that TOI was making all allegations because their TRP s had fallen and they had lost viewership since the launch of Republic TV. 

Goswami and Republic TV were supported by leading law firm Phoenix Legal and represented by Parag Tripathi and Sandeep Sethi. 

When contacted, a Times Now official refused to comment on the latest development, saying that the matter was sub judice.
